Job vacancy: Family/Child Care Solicitor

Based in the centre of Leeds we are currently seeking an experienced Child Care Solicitor to manage a caseload of interesting and at times, challenging public law cases as well as an element of private law children’s work.

Applicants should be on the Law Society’s Children's Panel or be prepared to work towards membership. They must be well versed in legal aid regulations and will have, or be prepared to develop, a trusted professional relationship and links with CAFCASS and other child care agencies.

Our Family Department is a very busy and fast moving environment, dealing with some of the most vulnerable sectors of the local community. Therefore, excellent advocacy, drafting and interpersonal skills; the highest standard of client care; good organisational skills; and the ability to produce consistently high quality work are all essential qualities. 

We are also LEXCEL accredited and therefore, applicants must be able to demonstrate an efficient, high standard of file management with their caseload.

Applications for this role will be considered on a full or part time basis with the opportunity to work alongside established child care lawyers.

Henry Hyams property department demand increases

The property department at Henry Hyams has continued to see demand for property transactions increase. April to August this year saw a 62% increase in new instructions, compared to the same period last year.

This reflects the on-going national trend as reported in The Times and The Independent this week. They report that Rightmove received over 4 million new enquiries to estate agents during August, the second highest amount it has ever registered.

Law Society Excellence Awards and Yorkshire Lawyer Awards

Henry Hyams are delighted to have been shortlisted for two prestigous awards.

Our work with the Manuel Bravo Project (http://www.manuelbravo.org.uk/ ) has been recognised with our shortlisting for the Law Society Excellence Award for pro bono work. Manuel Bravo Project are a Leeds based charity who work with refugees and asylum seekers. Henry Hyams provides specialist legal support.

We have also been shortlisted for a Yorkshire Lawyer Award for Enterprise in recognition of our innovative and client focused approach to business development. The award focuses on our achievements in our areas of practice and our dedication to our clients. Immigration Act 2014 - driving licence restrictions

The first Immigration Act provisions are to be introduced today, 14 July 2014. Driving licence restrictions are being brought in. Only people with lawful residence in the UK will be able to obtain a driving licence. The Home Office now has the power to revoke a driving licence when a person no longer has lawful residence. Changes to article 8, private and family life, are to be introduced on 28 July 2014. Updates to follow.

Appointment of New Partner

We are delighted to announce that as of 1st July Helen Camidge will be appointed as a partner at Henry Hyams. Helen joined the firm in 2009 as an associate solicitor. She has over 25 years’ experience in dealing with private client matters in family law. She specialises in divorce, cohabitation, finances, contact disputes and pre and post nuptial agreements. She is a Resolution accredited specialist and trained collaborative lawyer. Helen has played and continues to play a vital role in the expansion of Henry Hyams' private family law work.

Charles Dickens said in 1838 “the law is an ass”.  Those words can have no greater application than when applied to the Marriages (Same Sex Couples) Act 2013 which from the 29 March allows people in a same sex relationship to finally marry, or does it?

Wine Tasting Event

The 2nd annual Henry Hyams wine tasting event took place last Thursday evening and was a great success.

Guests from a variety of high profile organisations including estate agents, accountants, banks and educational institutions joined a number of our solicitors to enjoy an entertaining and educational evening.

The evening began with a brief presentation by Helen Camidge one of our senior family solicitors who informed guests of the excellent work we do for private clients as well as those supported by public funds. This was followed by a tasting session hosted by our very own sommelier and Managing Partner, Derek Hallam who chose some excellent wines and did a sterling job of keeping everyone entertained and focused even after the 11th tasting. Thanks to all who attended.

We hope to hold similar events in future and with guests from the Leeds business community. As Helen pointed out, we have many years of experience delivering a high quality service at competitive prices.

Henry Hyams expand pro bono work

Henry Hyams have long supported the Manuel Bravo project, an organisation that provides free legal advice to asylum seekers. In addition to existing pro bono work arrangements, we will now be supervising Manuel Bravo volunteers to work towards their Level 2 OISC qualifications. Given Manuel Bravo’s significant contribution to providing asylum seekers with much needed advice and assistance, we are delighted to be contributing to their contiuned work.

Home Office U-Turn for Visit Visa Applicants

The Home Office have announced a u-turn on £3000 Deposit Requirements for Visit Visa Applicants. They will not be requiring visit visa applicants from certain ‘high-risk’ countries (for example India, Pakistan and Nigeria) to pay a deposit as part of their applications.

This surprising change in proposed government policy is welcomed by anyone seeking to visit the UK from countries the Home Office consider to be ‘high-risk’. This is not to say that the Home Office are being lenient in decision making on visit visa applications. Given that there are no longer appeal rights in relation to visit visas to the Immigration Tribunal, it is important to have your applications prepared and checked fully before submitting it.

Same day premium service available for immigration applications

Changes have been introduced in relation to booking appointments for the Legal Representatives’ Same Day Service. This service enables your Legal Representative to attend an appointment at the Home Office with you and to receive a decision on your application on the same day. Appointments are now made using the online system.

Henry Hyams are able to access this premium service on your behalf. Should you be interested in this option, please do not hesitate in contacting our offices.

Home Office appeal crucial High Court Decision on family rules

This month the High Court held that the Family Immigration Rules requiring partners and spouses of British Citizens to have earnings of at least £18,600 were disproportionate and unjustified. The Judges particularly criticised the financial requirement as being too high and unattainable for most ordinary citizens.

The Court did not go as far as striking out the rules and, for the time being, they still stand. However, the decision is seen as an encouraging move towards a change.

On 26 July 2013, the Home Office appealled this crucial High Court Judgement. The Secretary of State has announced that she is of the view that the rules should remain unchanged.

It is hoped that the Court of Appeal will provide clear and decisive guidance in this matter.

Signs of expansion in the housing market

Henry Hyams’ Conveyancing Department has seen a 50% increase in new instructions this month as compared to the same period last year. Partner, Michael Bush, has brought a new recruit into the department to help deal with the increased workload.

Recent reports indicate that this is a long term trend and that the housing market is once again on the up.

Landlords to check immigration status

The Home Office are seeking to introduce new rules requiring private landlords and their letting agents to request proof of immigration status from tenants. These new rules, if not complied with, will attract fines of up to £3000.

Identifying immigration status is a very difficult process. At Henry Hyams, we will advise and assist you in checking immigration documentation to ensure you are compliant with these rules when they are applied. We can also help implement new procedures to protect you from these strict rules.

Henry Hyams has a new look!

Henry Hyams has been around since the 1930s and it is about time we had a facelift! 

Huge changes are afoot in the funding of legal services and we will continue to adapt as always to meet our clients’ requirements.  

We are also pleased to announce the opening of a new branch. Situated above the Citizens Advice Bureau in the Westminster Building of New York Street, our new branch will be open standard office hours, five days a week. We hope that this additional location will continue to attract clients old and new to the firm.

Legal aid cuts from 1 April 2013

As of 1 April 2013 the right to legal aid is massively reduced for anyone looking for legal advice in relation to family or civil litigation matters. If you did not apply for legal aid before 1 April then your case may not be eligible, even if you are in receipt of a limited income.    

Family Law

The only divorce case with legal aid will be one involving violence or domestic abuse. All other divorces will have to be paid for privately.  

If you want to make a formal arrangement for contact with your children to get legal aid you must come in before 1 April. After that date you will have to pay for legal advice, or deal with the court proceedings yourself.

We are pleased to be able to offer a fees package for family cases that we hope will suit any budget.  Please speak to a member of our family team for further information.

Housing

Those who are homeless and need help with the local authority will still get legal aid. If your home is in such poor repair that it is affecting your health, or could well do so, then legal aid is available. Legal aid is also available to defend an anti-social behaviour injunction or to bring a claim for unlawful eviction.
