Mental Health

One in four people will suffer from a mental health problem at some point in their lives.  It is a distressing, anxious and uncertain time not only for those suffering from the problem, but for their friends and family.

Henry Hyams can offer advice, assistance and representation to clients detained under the Mental Health Act 1983 as well as their families.

What we can do

We have a team of professionals dedicated to assisting those with difficulties involving mental health law. We have an extensive contract with the Legal Services Commission to provide help in the following areas:

• Mental Health Tribunals
• Hospital Managers Meetings
• Care Programme Approach/Section 117 Discharge Meetings
• Informal Patients with issues whilst detained
• Nearest Relative Representation
• Displacement of Nearest Relative
• Court of Protection
• Deprivation of Liberty Safeguards
• Human Rights
• Community Treatment Orders
• Unlawful Detention

The team’s wide range of experience means that we regularly assist restricted / forensic patients; those who also suffer from learning disabilities; those transferred to secure units from prison and also community patients.

Our Mental Health lawyers are able to travel to attend upon detained clients and work across Yorkshire, The Humber, Lancashire, Manchester and other areas of the North West of England.

How much will it cost?
If you need representation before the Mental Health Tribunal it is likely that you are entitled to free legal advice and assistance. Other mental health issues may require a means assessment before free legal advice can be provided. A member of our team will be happy to have a free consultation with you to discuss this further.

Other areas
Many of the areas of Mental Health law overlap other areas of law. Henry Hyams has a wide variety of departments, meaning all your matters should be dealt with continuously.

We have been successful in gaining compensation for the unlawful detention of our clients. For such matters, we have referred cases to our civil department.

We have a dedicated team of specialists dealing with Court of Protection matters and in particular how Mental Capacity law interfaces with Mental Health law.
